Governing Use of AI-Powered Refusal Response Generation | Compliant with Hong Kong SAR Law
For the purpose of this Agreement:
By accessing, downloading, or using the App (including generating any refusal response through the App's functionality), the User irrevocably accepts and agrees to be bound by all terms and conditions of this Agreement. If the User does not agree to these terms, they must immediately cease all use of the App and delete any content generated by the App.
The Provider reserves the right to modify this Agreement at any time. Modified terms will be posted on the App's interface and take effect 7 calendar days after posting. Continued use of the App after the effective date of modification constitutes acceptance of the revised Agreement.
The User warrants that they are at least 16 years of age, or have the legal capacity to enter into binding contracts under Hong Kong Law. For Users acting on behalf of an entity, the User warrants they have the authority to bind the entity to this Agreement.
The Provider reserves the right to verify User eligibility and suspend or terminate access to the App if the User fails to meet eligibility requirements or provides false information.
The Provider grants the User a limited, non-exclusive, non-transferable license to use the App for personal or legitimate commercial purposes, in accordance with this Agreement and Hong Kong Law.
App-Specific Restrictions: The User shall not:
The User is solely responsible for all content generated via the App and any consequences arising from the use of such content (including damage to personal/professional relationships or legal liability).
All intellectual property rights in the App (including AI algorithms, response templates, UI design, and brand elements) are owned by the Provider or its licensors. The User shall not claim any ownership rights to the App or its generated content.
The User may use the App's generated refusal responses for non-commercial purposes, provided such use complies with Hong Kong Law and this Agreement. The Provider retains all rights to anonymized, aggregated data derived from User interactions with the App (e.g., popular tone preferences, common relationship types) for improving the App's functionality.
The Provider complies with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong and shall handle User personal data (including email addresses, usage data, and response customization preferences) in accordance with the Data Protection Principles under the PDPO.
The Provider shall implement reasonable security measures to protect User personal data from unauthorized access, loss, or alteration, in line with Hong Kong's data protection standards.
The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, to the maximum extent permitted by Hong Kong Law. The Provider does not warrant that:
The App is a tool for reference only; the User shall exercise independent judgment when using the generated refusal responses and shall not rely solely on the App's output.
To the fullest extent permitted by Hong Kong Law, the Provider shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the App, including but not limited to damages from damaged relationships, loss of business opportunities, or reputational harm.
Nothing in this Agreement shall exclude or limit the Provider's liability for death or personal injury caused by its negligence, fraud, or willful misconduct, as required by Hong Kong Law. The Provider's total liability under this Agreement shall not exceed HKD 1,000 (Hong Kong Dollars) in aggregate.
This Agreement remains effective until terminated by either party. The User may terminate the Agreement at any time by ceasing use of the App and requesting deletion of their account (if applicable).
The Provider may terminate the Agreement immediately if the User violates any term of this Agreement (e.g., using the App to generate illegal refusal responses) or if the Provider ceases to offer the App. Upon termination, the User's license to use the App is revoked, and all generated content shall remain the User's responsibility.
This Agreement shall be governed by and construed in accordance with Hong Kong Law. Any dispute, controversy, or claim arising out of or in connection with this Agreement shall first be resolved through amicable negotiation between the User and the Provider.
If negotiation fails, either party may submit the dispute to the District Court of Hong Kong, which shall have exclusive jurisdiction over such disputes. The prevailing party shall be entitled to recover reasonable legal costs and expenses incurred in resolving the dispute.
